PLEASE READ THESE TERMS OF SERVICE CAREFULLY. BY ACCESSING, BROWSING OR OTHERWISE USING THE SERVICES YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD AND AGREE TO BE BOUND BY THESE TERMS. IF AT ANY TIME YOU DISAGREE WITH ANY OF THESE TERMS AND CONDITIONS, YOU SHOULD IMMEDIATELY CEASE YOUR USE OF THE SERVICES.

THESE TERMS CONTAIN A BINDING ARBITRATION AGREEMENT AND CLASS ACTION WAIVER. THEY AFFECT YOUR LEGAL RIGHTS, INCLUDING YOUR RIGHT TO SUE IN COURT OR HAVE A JURY TRIAL.These Terms of Use ("Terms") are a binding agreement between you and National Debt Relief LLC d/b/a MoneyMaya ("MoneyMaya," ”Maya,” "we," "us," or "our") governing your access to and use when you interact with our website www.moneymaya.ai, any affiliated mobile experience, and any related content, tools, forms, communications, and services that link to these Terms (collectively, the "Services").

By accessing or using the Services, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Services.

1. Who we are

MoneyMaya is a marketing and lead generation service owned by National Debt Relief LLC (“NDR”). The Services are designed to connect consumers with debt relief, personal finance, and other financial products or services that may be offered by NDR, and other third-party providers.

MoneyMaya may present, prioritize, or promote certain offers, including debt settlement solutions, as part of the Services.

MoneyMaya does not guarantee that you will receive any offer, approval, rate, pricing, savings result, or specific terms from any provider. Any product or service is offered solely by the applicable provider under that provider’s own terms, disclosures, eligibility criteria, and underwriting or enrollment standards.

Unless expressly stated otherwise, MoneyMaya is not the provider of any third-party financial product displayed through the Services.

2. Eligibility

You must be at least 18 years old and legally capable of forming a binding contract to use the Services.

You agree to provide accurate, current, and complete information and to promptly update it if it changes. The Services are intended for users located in the United States unless MoneyMaya expressly states otherwise.

3. Use of the Services and Accuracy of Information

You may use the Services only for lawful, personal, non-commercial purposes unless we expressly authorize otherwise in writing.

If you complete a form, request information, or otherwise submit information through the Services, you agree to provide information that is accurate, current, and complete.

You acknowledge that MoneyMaya, NDR or other providers may rely on the information you submit in evaluating your inquiry or determining what products or services may be presented to you. Inaccurate or incomplete information may affect the usefulness of the Services or your eligibility for products or services.

You may not:

  • Use the Services in violation of any law or regulation;

  • Submit false, misleading, or fraudulent information;

  • Infringe or violate the rights of any third party;

  • Scrape, crawl, index, frame, mirror, or harvest content, data, or personal information from the Services;

  • Bypass, disable, interfere with, or circumvent any security or access controls;

  • Introduce malware, viruses, malicious code, or harmful material; or

  • Use the Services in any manner that could damage, disable, overburden, or impair the Services or interfere with another person’s access or use.

We may investigate violations of these Terms and may suspend, limit, or terminate access to the Services if we believe your conduct violates these Terms or creates legal, reputational, or security risk.

4. Informational Content; No Financial, Legal, or Tax Advice

The Services may include educational materials, articles, calculators, comparison content, estimated savings information, offer information, and other content for general informational purposes only.

Nothing on the Services constitutes legal, tax, accounting, investment, credit repair, or financial advice. You are solely responsible for evaluating whether any product, service, or provider is appropriate for your circumstances.

Any examples, illustrations, estimates, rankings, or testimonials shown on the Services are for informational purposes only and do not guarantee that you will achieve the same or similar results.

5. Offers, Rankings, and Provider Information

The Services may display educational content, estimated savings information, provider information, or product and service offers in an order or format determined by MoneyMaya in its discretion.

The order, prominence, or inclusion of offers may be influenced by ownership relationships, commercial relationships, referral arrangements, your responses, geographic availability, or other factors. Accordingly, the Services do not necessarily present all available options or all providers in the marketplace, and any order or presentation should not be interpreted as a neutral ranking or a comprehensive market comparison.

Any rates, terms, approvals, savings estimates, or other offer details are subject to change and are determined solely by the applicable provider.

6. Third-Party Providers and Third-Party Content

The Services may contain links to, integrations with, forms submitted to, or content provided by third-party providers, including lenders, servicers, affiliates, advertisers, and other service providers (collectively, “Providers”).

MoneyMaya does not control and is not responsible for the Providers, including their products, services, offers, disclosures, underwriting decisions, servicing practices, content, availability, security, or privacy practices.

Your interactions and dealings with any Provider are solely between you and that Provider. You should review each Provider’s terms, disclosures, and privacy policy before submitting information or accepting any offer.

7. Communications consent

By submitting a form, requesting information, or otherwise providing your contact information through the Services, you agree that MoneyMaya, and their respective service providers and marketing partners may contact you regarding your inquiry, available products or services, and related marketing, to the extent permitted by applicable law.

Such communications may be made by phone call, text message, and email using the contact information you provide. Where permitted by law and consistent with the consent you provide, these communications may use automated technology, including an automatic telephone dialing system or prerecorded or artificial voice.

Your consent to receive marketing communications is not a condition of purchasing any goods or services. Message and data rates may apply. You may opt out of marketing emails by using the unsubscribe link in the message and may opt out of text messages by replying STOP, where applicable, or by contacting us at support@moneymaya.ai.

8. User submissions

If you submit reviews, feedback, testimonials, comments, or other materials, you grant MoneyMaya a non-exclusive, worldwide, royalty-free, transferable, sublicensable license to use, host, reproduce, adapt, publish, translate, distribute, and display that content in connection with the Services and our business.

You represent that you own or control the necessary rights in your submission and that it does not violate any law or infringe any third-party rights.

We may remove or decline to publish any submission at our discretion.

9. Intellectual property

The Services, including all software, text, graphics, images, designs, compilations, interfaces, trademarks, logos, service marks, and other content, are owned by MoneyMaya, NDR, or their licensors/affiliates and are protected by intellectual property and other applicable laws.

Except for the limited right to access and use the Services in accordance with these Terms, no right, title, or interest in or to the Services is transferred to you, and no license is granted except as expressly stated in these Terms.

10. Privacy

Our collection, use, and disclosure of personal information are described in the MoneyMaya Privacy Policy, which is incorporated into these Terms by reference.

11. Disclaimers

THE SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS TO THE FULLEST EXTENT PERMITTED BY LAW.

TO THE FULLEST EXTENT PERMITTED BY LAW, MONEYMAYA DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

MONEYMAYA DOES NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF HARMFUL COMPONENTS, OR THAT CONTENT IS COMPLETE, ACCURATE, OR CURRENT.

12. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, MONEYMAYA, NDR, THEIR AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, CONTRACTORS, LICENSORS, AGENTS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS OPPORTUNITY, ARISING OUT OF OR RELATING TO THE SERVICES OR THESE TERMS, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

TO THE FULLEST EXTENT PERMITTED BY LAW, THE TOTAL LIABILITY OF MONEYMAYA AND ITS RELATED PARTIES FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICES OR THESE TERMS WILL NOT EXCEED THE LESSOR OF: (A) ONE HUNDRED U.S. DOLLARS (USD $100); OR (B) THE AMOUNT YOU PAID, IF ANY, TO MONEYMAYA FOR USE OF THE SERVICES IN THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM.

13. Indemnification

You agree to defend, indemnify, and hold harmless MoneyMaya, their affiliates, officers, directors, employees, contractors, licensors, agents, and service providers from and against any and all claims, demands, actions, proceedings, liabilities, damages, judgments, awards, losses, costs, and expenses, including reasonable attorneys’ fees, arising out of or relating to:

  • your violation of these Terms;

  • your violation of any law; or

  • your infringement, misappropriation, or other violation of any third-party right.

14. Dispute resolution

Any dispute relating in any way to your visiting this website or your use of any of the Services shall be submitted to confidential, binding arbitration before the American Arbitration Association in New York, NY, except that, to the extent you have in any manner violated or threatened to violate MoneyMaya intellectual property rights, MoneyMaya may seek injunctive or other appropriate relief in any state or federal court in New York, and you consent to exclusive jurisdiction and venue in such courts. This dispute resolution clause shall be interpreted and governed exclusively by the Federal Arbitration Act. Arbitration hereunder shall be conducted under the Consumer Arbitration rules then prevailing of the American Arbitration Association. The arbitrator’s award shall be binding, but subject to review in accordance with applicable statutes, rules and regulations governing arbitration awards and may be entered as a judgment in any court of competent jurisdiction.You and MoneyMaya agree that any dispute resolution proceedings shall be conducted only on an individual basis and not in a class, collective, consolidated, mass, or representative action. You further agree to waive any right to participate in or bring any such class, collective, consolidated, mass, or representative proceeding, whether in arbitration or in court. To the fullest extent permitted by applicable law, no arbitration hereunder shall be joined to an arbitration involving any other party subject to these terms and conditions, whether through class arbitration proceedings or otherwise.

15. Changes to the Services or Terms

We may update the Services and these Terms from time to time. If we make material changes, we will post the updated Terms and revise the "Last Updated" date. Your continued use of the Services after the effective date of the updated Terms constitutes acceptance of the revised Terms.

16. Termination

We may suspend, restrict, or terminate your access to all or any part of the Services at any time, with or without notice, for any reason, including if we believe you have violated these Terms or your use poses risk to us, other users, or third parties.

17. General

These Terms constitute the entire agreement between you and MoneyMaya regarding the Services and supersede prior communications on that subject.

If any provision is held unenforceable, the remaining provisions will remain in full force and effect.

Our failure to enforce a provision is not a waiver of that provision.

You may not assign these Terms without our prior written consent. We may assign these Terms in connection with a merger, acquisition, reorganization, or sale of assets.
